HC asks Gawli to apply fresh for parole The Mumbai high court has directed Arun Gulab Gawli to put fresh application before the divisional commissioner Nagpur for his parole.
Arun Gawli had applied for emergency Parole from jail on the ground of his mothers illness stating that she was presently admitted in jaslok hospital at Mumbai.
Arun Gulab Gawli was granted emergency parole for period of one week by divisional commissioner Nagpur and accordingly he was released on emergency parole on 18/04/18 for 7 days.
On April 19, he made application for extension of parole for 30 days but as no decision was taken and therefore criminal writ petition bearing no 392/18 was filed praying for extension of parole.
Adv ketki Joshi appearing for state opposed the writ petition stating that in case of emergency parole no extension can be granted.
Therefore it was argued that petitioner be permitted to file regular parole application immediately and decision on said application be taken immediately so that petitioner can be present for his mothers treatment.
Accepting said contention division bench comprising of Vasanti Naik and Swapna Joshi directed petitioner to make application for regular parole and directed same to handed over to Adv ketki Joshi who shall in turn forward the same. Divisional commissioner was further directed to take decision on said application within 3 days. Petitioner was further directed to surrender on April 25.
